The Gluten-Free Controversy: Unveiling the Chick-Fil-A Lawsuit
Good morning it’s coffee time I am eron welcome to Brewing Better Living and this is gluten-free coffee talk that I do on Monday mornings and I’m going to jump right into it today apparently just found out there is a class action lawsuit Brewing against Chick-fil-A for charging more or actually.
Overcharging potentially on their gluten-free buns that they offer as an option um to have with their chicken sandwiches so let me give you a little read here Chick-fil-A gluten-free buns lawsuit Ada discrimination question mark attorneys working with classaction.com are investigating whether a class action lawsuit can be filed on behalf of.
Chick-fil-A customers who had to pay extra for needing gluten-free buns for their sandwiches this should be of no surprise to any of us who’ve eaten gluten-free for a period of time generally when you go to a restaurant the gluten-free food will tend to be more expensive comment down below if you’ve been someplace.
Where it’s not and I mean the actual like gluten-free pizzas versus regular gluten-free buns versus regular not if you happen to get something off the menu that is already like naturally gluten-free so to speak so anyway on we go specifically they’re looking into whether the fast food company is illegally discriminating against.
Customers with celiac disease wheat allergies or gluten intolerance by leving a considerable surcharge about $170 cents at some locations for gluten-free buns I didn’t realize the upcharge was that much because I I have never even had the gluten-free bun at Chick-fil-A but anyway the attorneys believe the upch.
Charge may not be in line with how much the Buns actually cost and that Chick-fil-A may be profiting off those who avoid gluten out of medical necessity do have celiac disease a wheat allergy or gluten intolerance if you had to pay extra to get gluten-free buns with your Chick-fil-A sandwich please fill out the form on this page and tell.
Us about it attorneys are specifically looking to hear from customers in California Colorado Illinois Massachusetts Minnesota New York and Texas so I’m here in New Jersey they don’t want to hear from me okay why might a gluten-free sarch charge constitute discrimination attorneys believe that people with celiac disease.
Wheat allergies or gluten intolerance are protected under the Americans with Disabilities Act or the Ada a federal civil rights law that prohibits discrimination against people with disabilities okay I don’t think that they says they believe people with r I’m pretty sure that people with Celiac are covered under that law within the.
Meaning of the Ada a disability is a physical or mental impairment that substantially limits major life activities such as eating and major bodily functions including digest digestion in importantly the Ada states that restaurants stores and other places of public accommodation cannot impose a sear charge canot impose a sear charge.
On individuals with disabilities to cover the cost of measures required to provide them with non-discriminatory treatment attorneys believe that Chick-fil-A’s surcharge for gluten-free buns may be both illegal and unnecessarily high as the actual cost of the product is nowhere near the $1 plus per sandwich up.
Charge um um in the same vein I did not know this either Starbucks and Duncan have already been hit with lawsuits claiming that the coffee chains violated the Ada and discriminated against customers with lactose intolerance or milk allergies by charging them an excessive search charge to add non-dairy milk to their.
Drinks okay so and then it goes on to tell you how to get in touch with them if you’re in one of those States and all of these things now I have my thoughts on this um do I think that it’s right to charge people a search charge on a thing like a gluten-free Bond or maybe on the gluten-free pizza or something like that.
And a lot of people are going to disagree with me on this but I’m going to say yes it is it is fair for them to charge that only because I think that we all understand that it costs more to make these um non-gluten containing foods um probably just the ingredients to make them is more expensive to the people Manu or the.
Company’s manufacturing them and then of course the restaurants have to pay more to have those items on their menu okay do I think that a 100 oh God could you imagine do I think that $1.70 is excessive yes I mean considering that you could go to the store and oh I don’t know I could be wrong with this one but you could buy a.
Thing uh an eight pack of regular gluten-free or I’m sorry regular gluten containing hamburger buns for like 99 Cents or a dollar something when they’re on sale specifically the store brands and things like that or or maybe maybe that was 10 years ago I don’t know but I’m saying I think that we understand that you’re going to pay more at the.
Restaurant but $1.70 that’s a lot um you know I have this idea like maybe they could just charge whatever the upch charge is like it if it cost them 15 cents more per bun to purchase these gluten-free buns maybe pass the 15 cent charge off to the customer um $1.70 or anything around there does.
Sound excessive but I think that we’ve all dealt with this um if you eat gluten-free and go out now there’s a couple other thoughts I have about this um let’s say that this does go through and you know it’s determined that Chick-fil-A is violating this um part of the um.
Ada and law and now every other place has to make sure that they’re not upch charging too is this going to affect all the other restaurants in the country if if Chick-fil-A loses this lawsuit depending on how far it goes and whatnot um and then this is the part that kind of really concerns me and I I don’t really go out to eat and I probably.
Wouldn’t be having the gluten-free bun and things of that nature anyway um but what if this goes through and places are forced to charge the same amount or just strictly the amount the difference amount and places stop carrying these gluten-free buns or the companies stop making them because now it’s no longer advantageous for them to do that because.
They’re making the same or maybe even losing money on these products so I think that that’s a very real concern too now getting into the whole Chick-fil-A thing uh because I see it all the time in the forums what’s what’s glutenfree at Chick-fil-A blah blah blah and um back when I was gluten-free years ago before my Celiac diagnosis I did eat.
A CH Fil-A quite often they had you know a couple things that were pretty decent that um you know were considered to be gluten-free I’m a lot more strict with myself now that I have a Celiac diagnosis so this is actually directly from Chick-fil-A’s website what’s gluten-free on the Chick-fil-A menu um so they do say we have a select list of.
Items that are sealed before entering our restaurants to help avoid cross contact with other items in our kitchen made with gluten gluten-free bun note once the bun is removed from the packaging it is no longer considered gluten-free because it may come into contact with ingredients in our kitchens that do not contain that do contain.
Gluten rather so that is that’s been my understanding is that they give you the bun and it’s already like package it’s packaged in plastic like they receive it that way it’s given directly to you so that you know that the bun inside is in fact gluten-free and just a little side note take that into consideration when when we’re considering the cost of these.
Items for the restaurant they’re not just getting these buns in like big like plastic containers or plastic bags or whatever they’re coming individually wrapped so that you know you would think is going to add a little bit to the cost to produce those items so they have that gluten-free bun on there they have an honest kids um organic Juice drink a.
Cinnamon apple sauce milk simply orange orange juice and Waffle potato chips okay this stuff is all sealed so we can all agree that that is you know that if it’s glutenfree it’s gluten- free and then other menu options and they go on again to say we can’t ensure that our restaurant environment or any menu item prepared in.
The restaurant other than those above which are those packaged foods will be completely free of gluten however for our guests who are looking to minimize gluten intake we suggest the following menu items so directly from Chick-fil-A their items are not glutenfree if you’re looking in terms of cross contact they’re admitting right.
Here that stuff can be contaminated in their shared prep areas so that is something very important and I think that’s why since I was officially diagnosed I do not one of the reasons why I do not eat at places like this okay as good as those waffle fries may be and I miss those waffle fries I really do but they go on to talk about.
They’re um for breakfast bacon sliced sausage patty hash browns they hash brown scramble um lunch and dinner grilled chicken fillet and the grilled nuggets which I have heard are not made with gluten containing ingredients they have a couple salads their fruit cups um waffle potato fries this is a point of contention I see all the time in in.
Various forums uh it’s my understanding that Chick-fil-A uses a separate fryer to fry their waffle fries in using a different type of oil I believe if I the way I read it prior was they use like um a like refined peanut oil and then when they fry their like chicken their fried chicken products um like their uh breaded chicken sandwiches and regular.
Chicken nuggets they’re fried in a fryer with a different type of oil it might be canola oil or something like that but either way they they’re saying right here that none of this stuff is necessarily for someone who is celiac um so for our guests who are looking to minimize their gluten intake.
Let me repeat that so be aware of that um the next time you’re wondering what’s gluten-free at a fast food place they have their treats frosted coffee frosted lemonade some of their ice cream stuff um they list their gluten-free sauces okay let me see what else is here and I could have sworn I saw a milkshake on here and looks like I would be wrong now.
So they do have some things that are maybe okay for people with um like an intolerance but probably not celiac disease I am sorry so just something to keep in mind about eating out in general uh when you’re dealing with especially a fast food restaurant but very interesting with that um potential ad violation with the.
